We know there’s been a lot of talk about abortion laws since Roe v Wade was overturned. It can be overwhelming and confusing, especially if you’re dealing with a potential pregnancy and trying to explore your options. But don’t worry, we’re here to help you understand the latest abortion laws in North Carolina as of May 23, 2023.

The new law says you can only have an abortion until you’re 12 weeks pregnant. Before, it was allowed until 20 weeks. This change will begin on July 1, 2023, and it applies to the whole state. However, there are exceptions to this rule. If you are pregnant because of rape or incest, or if the baby has serious health problems, you can still have an abortion after 12 weeks.

Understanding all the legal and medical language surrounding abortion laws can be confusing, but here are a few important things to remember:

  1. Abortion is still legal in North Carolina
Unlike some other states, such as Texas or Alabama, North Carolina has not implemented a total ban on abortion. Instead, the recent rulings have established a 12-week window or limit within which you can decide whether or not to seek an abortion.
  2. Women’s Health Remains a Priority
You may worry that in medical emergencies like ectopic pregnancies or miscarriages, important life-saving procedures might not be allowed…this is not the case and these necessary medical procedures will still be done without being limited by how far along you are in your pregnancy.
  3. What about rape or incest?
The new abortion law acknowledges situations involving rape or incest by extending the 12-week abortion limit to 20 weeks. This ensures that individuals in such circumstances have plenty of time to make decisions regarding their options.
  4. Are there any other exceptions?
Yes. If doctors find a serious medical concern with the baby that will affect its life, the 12-week limit is extended to 24 weeks. This provision allows you more time to consider your options and whether or not you desire to have an abortion.
